Come conseguenza a tali affermazioni di princpio,il nuovo pacchetto di regole e procedure introdotto dalla UE con la Direttiva 115/2008,è basato sul pieno riconoscimento e rispetto dei fondamentali diritti umani e della dignità dei cittadini stranieri clandestini e/o irregolari ed in cui viene sottolineata l’importanza di tenere in debito conto dalla Autorità procedente al rimpatrio

la vita familiare,
le condizioni di salute del cittadino straniero soggetto a rimpatrio
il principio del non-refoulement, cioè il divieto esplicito di espulsione e di rimpatrio di profughi verso i Paesi dove la loro vita o la loro libertà è in pericolo.
Appare,innanzitutto,indispensabile guardare all’interesse superiore dei bambini immigrati.
b.le politiche nazionali in tema di immigrazione ed asilo dei minori
Le politiche contemporanee riguardanti i minori stranieri sono regolate in parte dalle norme relative all’immigrazione e all’asilo emanate dai singoli Stati e in parte dalle norme relative ai children's rights, among which has particular relevance to the New York Convention on the Rights of the Child.

In this way, policies regarding foreign children are to be removed from the logic of repression and control that govern the general immigration policies enacted by the States.
Often, however, in violation of the Convention in New York, norms and practices tend to give precedence to the logic of control over the "best interests of the child."
To meet its commitments to livello internazionale e le leggi vigenti nel nostro ordina mento è,quindi,necessario che le istituzioni italiane modifichino le norme che regolano lo status dei minori stranieri e le relative prassi in direzione di un’effettiva applicazione di tale principio e di una piena garanzia dei diritti riconosciuti dalla Convenzione sui diritti del fanciullo.
Invero,i minori stranieri che subiscono maggiori violazioni dei diritti sanciti dalla Convenzione di New York sono i minori entrati in Italia clandestinamente.
c. La individuazione di uno status dei minori irregolari e clandestini
Occorre,anzitutto,definire lo status dei minori irregolari e clandestini.

3. What are the problems of their integration in Italy

4.Il rimpatrio dei minori non accompagnati
Un problema ancora più rilevante è costituito dal rimpatrio.
I minori in generale non possono essere espulsi; tuttavia, può essere disposto il “rimpatrio assistito” del minore se un organo apposito, il Comitato per i minori stranieri, stabilisce che questo è nel “superiore interesse del minore”.
L’attuale orientamento del Comitato per i minori stranieri, però, è che tendenzialmente tutti i minori non accompagnati di cui si rintracci la famiglia nel paese d’origine dovrebbero essere rimpatriati, ad eccezione dei casi in cui questo comporti gravi rischi per il minore.
Nella maggior parte dei casi il rimpatrio viene eseguito coattivamente dalla Polizia, contro la volontà del minore e in genere anche contro la volontà dei genitori, con modalità molto simili ad un’espulsione e, per di più, senza che il minore abbia effettive possibilità di presentare ricor so.
Inoltre, per molti di questi minori il rimpatrio significa tornare in contesti molto poveri, in cui vi sono scarsissime opportunità di istruzione, di lavoro e di assistenza.
Questa prassi, dunque, non sembra rispondere effettivamente al “superiore interesse del minore”, quanto piuttosto all’esigenza di contrastare l’immigrazione irregolare di minori non accompagnati.

Inoltre, per garantire il diritto dei minori a vivere con i propri genitori ed attuare il dettato della legge secondo cui in tutti i procedimenti relativi al ricongiungimento familiare si deve tenere conto di tale principio,nonché per ridurre il numero di minori ricongiuntisi irregolarmente, si dovrebbero rendere meno restrittive le condizioni per il ricongiungimento familiare (condizioni relative al reddito, all’alloggio ecc.) e rendere più rapide ed efficienti le relative pratiche burocratiche.

A seguito alle nuove disposizioni introdotte dalla legge Bossi-Fini,è necessario che siano previste specifiche garanzie per i richiedenti asilo minorenni.

Molto importante è anche l’art. 371 c.c. che demanda al Giudice Tutelare il compito di stabilire il luogo in cui il minore sottoposto a tutela deve vivere e che, rispetto ai minori stranieri non accompagnati è stato per analogia interpretato da alcune realtà locali, come attribuente all’autorità giudiziaria la valutazione dell’interesse o meno del minore a rimanere in Italia o ad essere rimpatriato.
Dall’esame della situazione del minore solo in Italia, emerge come negli anni successivi alla legge Martelli, la disciplina che si applicava a tali minori fosse complessa ed eterogenea.
In quegli anni, grazie all’intervento molto pressante dell’autorità giudiziaria, si ottenne che il nostro paese portasse l’attenzione sui minori stranieri in generale, al di là dell’esistenza in our country of a parent or family member regularly.

Altre fonti, invece, sostengono che il fenomeno è troppo fluttuante per offrire stime scienti fiche,infatti,non esistono uffici pubblici, né del volontariato sociale, che riescano a quan tificare in maniera palmare l’accattonaggio in Italia.
g.le cause del fenomeno
Due sarebbero le cause legate all’inasprirsi di questo fenomeno.
Innanzitutto, l’aumento dei flussi migratori verso l’Europa.
I principali paesi d’origine, infatti, dei flussi di tratta verso l’Italia per motivi di accattonaggio sono: Romania, Albania, Moldavia, Bulgaria e Marocco.
Moltissimi minori stranieri,poi,vengono abbandonati e di conseguenza sono facilmente preda di chi li intende sfruttare. Secondo il Dossier Fides, dal 2000 al 2005, sono stati identificati ben 50.000 minori stranieri abbandonati.I piccoli coinvolti sono: bambini di nazionalità romena (39%); marocchina (22%); albanese (15%); dell’Europa orientale e del Nord Africa (24%).
Nella maggior parte dei casi, si tratta di adolescenti al di sopra dei 15 anni (81%) e la loro presenza è più numerosa in Lombardia (23%) e nel Lazio (16%).
La seconda causa, invece, riguarda gli elevati guadagni legati all’accattonaggio che porta il giro d’affari delle organizzazioni criminali a circa 500 milioni all’anno.
Infatti, ogni bambino può rendere circa 100 Euro al giorno.

Se al termine della giornata non hanno raccolto il minimo previsto, sono intimoriti e percossi.
Spesso, per non incorrere in queste pene, la persona che usa il minore nell’accattonaggio non è un parente oppure lo si manda per strada da solo, minacciandolo di punizioni se non porta a casa i soldi.
Tali accorgimenti sono frequenti tra i nomadi e non sono purtroppo rari i casi in cui i bambini vengano appositamente storpiati per suscitare pietà.
Accade anche che i piccoli siano addirittura imbottiti di sedativi, affinché stiano buoni e tranquilli in braccio alle madri che chiedono l’elemosina sui marciapiedi.
Questi bambini maltrattati da grandi diverranno a loro volta “capetti”, ricreando the cycle of exploitation.

La Suprema Corte, decidendo in relazione ad caso in cui era stato contestato all’imputato il reato di cui all’art. 600 c.p., per aver ridotto in schiavitù e sfruttato per l’accattonaggio dei minori e degli handicappati, ha affermato che la finalità di sfruttamento, che distingue il suddetto reato da altre forme illegali di inibizione della libertà personale, non è esclusa dall'eventualità che un margine degli introiti dell'accattonaggio vada a beneficio delle persone offese dal reato.
Determinante ai fini della decisione e' apparso,invece,lo stato di soggezione in cui queste ultime versino essendo sottoposte all'altrui potere di disposizione che si estrinseca nell'esigere, con violenza fisica o psichica, prestazioni sessuali o lavorative, accattonaggio o altri obblighi di fare.

Il fenomeno più evidente di sfruttamento dei minori è rappresentato dai bambini che, soprattutto nella zona centrale o vicino alle stazioni, vendono ogni genere di mercanzia e che vengono definiti "baby mendicanti".
Spugnette,accendini e fazzolettini costituiscono la loro merce di scambio, venduta nei parcheggi o ai semafori: qualcuno compra, spesso vengono allontanati con fastidio, ma pochi si chiedono cosa ci facciano lì e chi li sfrutti ovvero denuncino alle Autorità l’illecito sfruttamento.
Da alcuni anni,ormai, gli investigatori delle varie Procure della Repubblica stanno cercando di scoprire chi siano gli adulti a capo di questa organizzazione.
Un lavoro di "intelligence", di indagine, difficile e faticoso: il reato ipotizzato è quello di "riduzione in schiavitù".
L'inchiesta non è facile anche per il clima di omertà e paura in cui vivono i bambini, soprattutto per provare i maltrattamenti che subiscono.
i.Conclusioni
Il traffico di esseri umani e' ormai un problema su scala mondiale che coinvolge ogni anno almeno 1.200.000 minori al di sotto dei 18 anni.
La ''materia prima'' si trova nei paesi poveri ed è costituita da una umanita' indifesa e tradita sfruttata da associazioni criminali e che costituisce gli schiavi del XXI secolo, un numero di ragazzi increasing, particularly in certain regions of the world.

Dinanzi al dilagare del fenomeno,è giunto il momento per la istituzione in Italia di un Osservatorio Nazionale per i Minori Immigrati che, da una parte, affronti il problema della criminalità minorile straniera e dall’altro si occupi di apprestare gli strumenti di intervento in una materia così delicata che affligge la nostra società contemporanea.
Non bisogna dimenticare che i minori stranieri non accompagnati sono tre volte vulne rabili:
perché minori, stranieri e soli !...
