The issue of migrants has become increasingly important nThe last year in the European context and that made the imminent necessity of forming a common European immigration law that would give directives on the management, above all, protection of migrants' rights and statelessness with particular regard to vulnerable people such as the elderly, the disabled, women and children.

b.le politiche nazionali in tema di immigrazione ed asilo dei minori
Le politiche contemporanee riguardanti i minori stranieri sono regolate in parte dalle norme relative all’immigrazione e all’asilo emanate dai singoli Stati e in parte dalle norme relative ai diritti dei minori, tra le quali ha particolare rilevanza la Convenzione di New York sui diritti del fanciullo.
La Convenzione, recepita dal nostro ordinamento con valore di legge,riconosce a tutti i minori – compresi i minori stranieri, anche se irregolari – un’ampia sfera di diritti:
il diritto alla non discriminazione, alla protezione, a vivere con la propria famiglia, alla salute, all’istruzione, a un livello di vita sufficiente allo sviluppo del minore, a non essere detenuto se non come provvedimento di ultima risorsa e in strutture separate dagli adulti, alla partecipazione,ecc.
Tra i suoi principi generali, sia la Convenzione che la Direttiva UE 115/208 stabiliscono che tutte le politiche riguardanti i minori debbano fondarsi preminentemente sul principio del “superiore interesse del minore”.
Il fine primario da perseguire, dunque,è il bene del minore ed è questo che deve avere la priorità rispetto ad altri obiettivi quali,ad esempio,il contrasto dell’immigrazione clandestina.
In questo modo, le politiche riguardanti i minori stranieri vengono ad essere sottratte alle logiche di controllo e repressione che governano in generale le politiche migratorie varate dagli Stati.
Spesso,tuttavia, in violazione della Convenzione di New York, le norme e le prassi tendono a far prevalere la logica di controllo su quella del “superiore interesse del minore”.
Per rispettare gli impegni assunti a livello internazionale e le leggi vigenti nel nostro ordina mento è,quindi,necessario che le istituzioni italiane modifichino le norme che regolano lo status dei minori stranieri e le relative prassi in direzione di un’effettiva applicazione di tale principio e di una piena garanzia dei diritti riconosciuti dalla Convenzione sui diritti del fanciullo.
Invero,i minori stranieri che subiscono maggiori violazioni dei diritti sanciti dalla Convenzione di New York sono i minori entrati in Italia clandestinamente.
c. La individuazione di uno status dei minori irregolari e clandestini
Occorre,anzitutto,definire lo status dei minori irregolari e clandestini.

La normativa italiana prevede che sia respinto e rimpatriato senza nessun tipo di tutela.
Infatti il nostro ordinamento non prevede la possibilità per il minore di entrare nel territorio da solo per motivi di lavoro.
Se comunque il minore riesce ad entrare, eludendo i controlli alla frontiera, allora, data la sua posizione di minorenne potrà usufruire di tutta una serie di strumenti che potranno, almeno temporaneamente tutelarlo.
È prima di tutto dal dettato costituzionale che emerge la figura del minore non più destinatario di un generico favor imposto dall'alto, ma titolare di veri e propri diritti soggettivi, perfetti ed azionabili.
Nella Costituzione si rinvengono norme a tutela del minore sia tra i principi fondamentali, artt. 2, 3, sia nella parte relativa ai diritti e doveri dei cittadini, sia nel titolo riguardante i rapporti etico-sociali, artt. 29, 30, 31, e nella parte relativa ai rapporti economici, art. 37; tale complesso di norme tutela il minore come 'uomo',' cittadino', come 'figlio', come 'lavoratore' e mai come personalità da forgiare per renderla conforme ad una astratta morale di stato o della famiglia).
Dopo l'introduzione della legge Martelli che non affrontava se non marginalmente l'aspetto dei minori, è stata determinante la legge 27 maggio 1991 n. 176, che ha ratificato la Convenzione sui diritti dei fanciulli di New York del 1989, tale provvedimento è la più compiuta espressione normativa sui diritti del fanciullo e con i suoi 54 articoli, costituisce un documento complesso. La Convenzione rafforza, per ciò che concerne le modalità formative ed educative del minore, le norme sopra viste della Costituzione italiana, ponendo il superiore interesse del minore quale chiave di lettura circa la predisposizione delle misure da attuare nei suoi confronti.
L'art. 3 afferma che "l'interesse superiore del fanciullo" debba essere la prima considerazione, in tutte le decisioni che lo riguardano e da qualunque soggetto provengono, compresi gli organi legislativi, ribadendo l'importanza di "soddisfare le speciali e specifiche esigenze dell'infanzia e dell'adolescenza";rispetto ad altre esigenze in concorso, le esigenze del minore, potranno prevalere oppure no, ma dopo essere state oggetto di primaria considerazione.
L'art. 20 dichiara il diritto di ogni fanciullo, temporaneamente o definitivamente privato del suo ambiente familiare, ad una protezione e ad aiuti speciali dello stato di origine, e ove esso non li garantisca, alla protezione sostitutiva degli stati parti.
Tale assistenza può realizzarsi, continua l'articolo, attraverso custody, adoption or placement in care.

Per il minore, dunque, viene prevista una tutela 'forte', che non ammette alcuna distinzione 'per ragioni di razza, di colore, di sesso, di lingua, di religione, di opinione politica o di altro genere'.
Questo significa che al minore straniero in Italia si applicheranno le normali misure di protezione previste dalle nostre leggi.
I minori non accompagnati clandestini
Iminori in una condizione particolarmente problematica sono i minori non accom pagnati, ovvero i minori immigrati in Italia senza i propri genitori.
1.Quali e quanti sono i minori non accompagnati
Vengono tecnicamente definiti “minori non accompagnati” i bambini che, come stabilisce il DPCM 535/99,vivono nel nostro Paese senza avere la cittadinanza italiana (o di altri stati dell’UE) e senza la presenza dei genitori o altri adulti che li assistano e ne siano formalmente responsabili.
Quello dei bambini stranieri soli è un fenomeno cresciuto in modo rilevante nel corso degli anni Novanta assieme all’immigrazione.
Al fine di quantificarlo e monitorarlo è stato istituito il “Comitato per i minori stranieri” (CMS), operativo ormai da dieci anni (art. 33 D.Lgs. n. 286, 25.07.1998).
Secondo i dati più aggiornati raccolti dal CMS, al primo gennaio 2008 i bambini stranieri extracomunitari soli risultano essere oltre 7.500.

Va in aggiunta considerato che tra i “minori non accompagnati” prevale ampiamente il sesso maschile (oltre il 90% dei casi), ed è comunque rilevante la quota dei più piccoli (gli under 15 sono un quarto del totale).
2.Cosa facciamo per loro?
Secondo una recente indagine dell’ANCI (Associazione Nazionale dei Comuni Italiani), sono 1.110 i Comuni che tra il 2004 e il 2007 hanno preso in carico un minore straniero non accompagnato, concentrati soprattutto in Lazio, Emilia-Romagna e Lombardia.
Tra gli aspetti problematici messi in luce vi è l’elevato onere economico sul welfare locale (si stima un costo medio per Comune di circa 170 mila euro) e un quadro normativo definito “complicato e ambiguo”, che rende frammentata e molto diversificata la risposta che a questo delicato fenomeno viene data sul territorio nazionale.
Un ultimo dato che denota la poca efficacia delle misure adottate è anche il fatto che la grande maggioranza dei minori (oltre il 60%) fugge dalle strutture di prima accoglienza alle quali è affidato.
Nonostante quindi i progressi degli ultimi dieci anni, le misure di risposta a questo delicato e complesso fenomeno rimangono insoddisfacenti.
Allo stato attuale, una parte rilevante del fenomeno rimane invisibile, la maggioranza dei minori fermati fugge dai centri ospitanti, i costi per i Comuni sono considerati molto rilevanti, le modalità di azione sul territorio sono molto diversificate conseguenza di un quadro norma tivo poco chiaro.
Dal punto di vista delle risorse, la Legge Finanziaria 2008 del precedente Governo aveva aumentato il Fondo per l’inclusione sociale degli immigrati, che andava a beneficio anche dei minori non accompagnati.
Nel marzo 2008 la Corte Costituzionale (sentenza 50/2008), pur riconoscendone l’importanza e l’utilità, ha però dichiarato incostituzionale tale Fondo perché riguarda materie di competenza locale e non solo statale.
I Comuni dicono di sentirsi abbandonati a se stessi nell’affrontare questo problema e quando lo Stato se ne occupa si trova con le mani legate.
Nel frattempo si consolida il numero di minorenni stranieri ospitati dal sistema penitenziario italiano.
Se il peso degli stranieri sugli under 18 residenti è pari circa al 6%, sono invece di cittadinanza non italiana ben il 60% degli ingressi negli istituti penali per minori

3.Quali sono i problemi del loro inserimento in Italia
Va innanzitutto sottolineato come le norme vigenti tendono ad ostacolare l’integrazione dei minori stranieri:

4.Il rimpatrio dei minori non accompagnati
Un problema ancora più rilevante è costituito dal rimpatrio.
I minori in generale non possono essere espulsi; tuttavia, può essere disposto il “rimpatrio assistito” del minore se un organo apposito, il Comitato per i minori stranieri, stabilisce che questo è nel “superiore interesse del minore”.
L’attuale orientamento del Comitato per i minori stranieri, però, è che tendenzialmente tutti i minori non accompagnati di cui si rintracci la famiglia nel paese d’origine dovrebbero essere rimpatriati, ad eccezione dei casi in cui questo comporti gravi rischi per il minore.
Nella maggior parte dei casi il rimpatrio viene eseguito coattivamente dalla Polizia, contro la volontà del minore e in genere anche contro la volontà dei genitori, con modalità molto simili ad un’espulsione e, per di più, senza che il minore abbia effettive possibilità di presentare ricor so.
Inoltre, per molti di questi minori il rimpatrio significa tornare in contesti molto poveri, in cui vi sono scarsissime opportunità di istruzione, di lavoro e di assistenza.
Questa prassi, dunque, non sembra rispondere effettivamente al “superiore interesse del minore”, quanto piuttosto all’esigenza di contrastare l’immigrazione irregolare di minori non accompagnati.

I minori irregolari
Oltre ai minori non accompagnati,vi sono poi i minori entrati irregolarmente in Italia insieme ai genitori o per ricongiungersi ad essi.

L’obiettivo è quello di evitare che il ragazzo scappi e finisca nella rete dello sfrutta mento senza alcuna tutela giuridica ma, soprattutto, che diventi un invisible. "

One of the most often in children who arrive in a European country like Italy, are exploited and begging.
It is one of the oldest forms of profit which sees the involvement of children and one of the most shameful ways in which a child is being exploited. The sad phenomenon

Oggi,accanto a queste 3-4.000 presenze, si sono aggiunti minori albanesi che sembrano far parte di un vero e proprio racket, dipendente da organizzazioni dedite all’immigrazione clande stina, e che si occupano di inserire questi minori in Italia.
Secondo l’Osservatorio sul lavoro minorile, in Italia, sono più di 8.000 i bambini, per lo più stranieri, sfruttati e costretti a mendicare dal racket; mentre, per il Dossier Fides, sarebbero circa 20.000 i piccoli accattoni presenti in Italy, of which only 8,000 populate the region of Lazio.

Alcuni bambini invece vengono “trattati meglio”: sono quelli destinati ai pedofili.

La Suprema Corte, decidendo in relazione ad caso in cui era stato contestato all’imputato il reato di cui all’art. 600 c.p., per aver ridotto in schiavitù e sfruttato per l’accattonaggio dei minori e degli handicappati, ha affermato che la finalità di sfruttamento, che distingue il suddetto reato da altre forme illegali di inibizione della libertà personale, non è esclusa dall'eventualità che un margine degli introiti dell'accattonaggio vada a beneficio delle persone offese dal reato.
Determinante ai fini della decisione e' apparso,invece,lo stato di soggezione in cui queste ultime versino essendo sottoposte all'altrui potere di disposizione che si estrinseca nell'esigere, con violenza fisica o psichica, prestazioni sessuali o lavorative, accattonaggio o altri obblighi di fare.

La ''materia prima'' si trova nei paesi poveri ed è costituita da una umanita' indifesa e tradita sfruttata da associazioni criminali e che costituisce gli schiavi del XXI secolo, un numero di ragazzi in aumento, soprattutto in alcune regioni del mondo.
Una rete di vendite e spostamenti che rende 1,2 miliardi di dollari l'anno, come altri tipi di traffici illeciti, dalle armi alla droga.
Occorre un maggior rispetto delle leggi, maggior controllo ed assistenza nei confronti delle fami glie disagiate ed una mirata informazione all’opinione pubblica sul fenomeno.
Chiedere elemosina significa stare per strada ogni giorno, non frequentare la scuola, non gioca re, non socializzare con altri coetanei.
Significa obbligare il bambino ad una vita che non gli appartiene e obbligarlo a non credere in un futuro migliore.
Significa annientare i suoi diritti.

Tale violenza, spesso, rimane nascosta e socialmente accettata e per molti bambini è una routi ne.
Nella maggior delle volte è commessa da persone di cui i bambini si fidano e comprende la violenza fisica, psicologica, la discriminazione, l’abbandono e il maltrattamento.
La grande differenza tra maschi e femmine è che, i primi, sono più a rischio di violenze fisiche rispetto alle femmine, le quali sono invece più soggette a violenze sessuali, abbandono ed induzione della prostituzione.
Non esistono uffici pubblici né del volontariato sociale che riescano a quantificare in maniera palmare il fenomeno nel nostro paese.
L'unica certezza è sulla nazionalità: sono quasi tutti immigrati stranieri.
Difficile è anche scoprire quante ore i bambini vengono tenuti in strada,dove dormono,dove mangiano, a chi siano affidati.
Ma l'altro problema è rappresentato dalla scarsità di posti di ricovero per questi bambini che vengono strappati ai loro padroni.
Una questione che la legge non risolve, anche perché, minori di 14 anni, non possono essere espulsi.
