Blueprint For Hair Salon

the health of the alien subject to repatriation

The principle of non-refoulement, which is the explicit prohibition of expulsion or return of refugees to countries where their lives or their freedom is in danger.
appears, first, must look the best interests of immigrant children.
b.le national policies on immigration and asylum policies
children about contemporary foreign minors are governed in part by the rules relating to immigration and asylum adopted by individual states and in part by the rules on children's rights , among which has particular relevance to the New York Convention on the Rights of the child.
The Convention, ratified by our regulations with the force of law, recognizes that all children - including foreign children, even if irregular - a wide scope of rights: the right to
non-discrimination, protection, to live with their family, health, education, standard of living adequate for the development of the child, not to be detained except as a measure of last resort and in separate facilities from adults, participation, etc..
Among its general principles, the Convention and the EU Directive 115/208 state that all policies relating to children should be based predominantly on the principle of "best interests of the child."
The primary goal to pursue, then, is the good of the child and that is what should have priority over other objectives such as, for example, the fight against illegal immigration.
In this way, policies regarding foreign children are to be removed from the logic of repression and control that govern the general immigration policies enacted by the States.
Often, however, in violation of the Convention in New York, norms and practices tend to give precedence to the logic of control over the "best interests of the child."
One of the most important is the figure of unaccompanied foreign minors present on Italian territory illegally, not asylum or humanitarian protection and emigrated with the consent of the substantial legal guardian or at least not against their will.
The issue of treatment of unaccompanied minors is a very complicated matter, because many provisions coexist fragmented and partly contradictory to each other, giving rise to enormous difficulties in orientation and therefore judicial practices varied among them. These guys immigrate
hoping for a decent survival, with the blessing and sacrifice large (or loss) of their parents.
While it may be driven by a frenzy of consumerism, the reasons for their displacement are to be found mainly in need.
It is possible that someone is immediately attracted to patterns of life that is unlawful or if there is already foreshadowed before reaching our country, but it is more likely that the majority of foreign students who are guilty of wrongdoing, it is because of the difficulties and obstacles and receives little help along the path looking for a decent and dignified social inclusion: home, school, work, socialization, identity protection.
Questa discipline is not always applicable to the adolescent alien minor who represents the band feels most numerous in Italy.
unaccompanied minors arrived at the border.
Italian law that should be dismissed and repatriated without any protection.
fact, our system does not provide for a child to enter the territory by himself for work.
If however the child is able to enter, evading border controls, then, given its position as a minor will benefit from a range of tools that can, at least temporarily protect it.
is above all the constitutional provisions that the figure of not less than the recipient favor of a generic top-down, but the owner of real individual rights, perfect and actions.
rules are found in the Constitution to protect the child is among the fundamental principles, Arts. 2, 3, and in part on the rights and duties of citizens, both in the title on the ethical and social relations, Arts. 29, 30, 31, and in part on economic relations, art. 37; set of rules that protect the child as 'man', 'citizen', as 'son', as 'worker' and never as a personality to forge in order to conform to an abstract moral status or family).
After the introduction of the Martelli Law that did not address the appearance of only marginally lower, was determining the law No 27 May 1991 176, which has ratified the Convention on the Rights of Children in New York in 1989, this measure is the most complete expression regulation on the Rights of the Child and its 54 articles, is a complex document. The Convention reinforces, for what concerns the way training and education of the child, the rules above views of the Italian Constitution, putting the interests of the child as the key to reading about the preparation of measures to be taken against him.
Article. 3 states that "the interests of the child" should be the primary consideration in all decisions concerning them and come from any subject, including legislative bodies, ribadendo l'importanza di "soddisfare le speciali e specifiche esigenze dell'infanzia e dell'adolescenza";rispetto ad altre esigenze in concorso, le esigenze del minore, potranno prevalere oppure no, ma dopo essere state oggetto di primaria considerazione.
L'art.
Tale visione sottolinea l'importanza di differenziare la posizione del minore alien from that of ensuring the child a right to education, training, growth does not mirror the citizenship but designed as a primary law which is independent and that it creates obligations for the state in which the child is located. In
art. 22 reaffirming the priority of the right of minors who seek 'refuge' for the protection and humanitarian assistance in the state of arrival, then the States Parties undertake to take steps including "to trace the parents or other family members ... to obtain information necessary for reunification with his family. "
protection of minors and the identification of the applicable law of the competent authority is under Article 42 of Law May 31, 1995 No 218 Reform of the Italian system of private international law, with reference to the Hague Convention of October 5, 1961, implemented in Italy by Law 24 October 1980, n.742
According to art. 1 of this Convention to the authorities, judicial or administrative, of the state of habitual residence of a child is competent to take measures for the protection of his person and property.
The administrative and judicial state of habitual residence shall take measures under their domestic law, as stated in the Convention of 1961.
For the child, therefore, protection is provided 'strong', which does not allow any distinction 'for reasons of race, color, sex, language, religion, political or other '.
This means that foreign minors in Italy to apply the usual protection provided by our laws.
Unaccompanied minors illegal
Iminori in a particularly problematic are not accom panied minors, or minors immigrants in Italy without their parents. 1.What
and those who are unaccompanied minors
are technically defined as "unaccompanied" children, as stipulated in the Prime Ministerial Decree 535/99, living in our country without Italian citizenship (or other EU countries) and without the presence of parents or other adults who assist them and who are formalmente responsabili.
May majority of undocumented children alone.
Save the Children, for example, has collected evidence of how in many cases, immigrant children at the time of identification claiming to be an adult hoping to not be detained and then find a job more easily.
should also be considered that since January 1, 2007 children from Romania and Bulgaria became EU and, thus, not attributable to the CMS, but the problematic nature of their condition is not resolved.
At December 31, 2006, when they were still registered, the Romanians constituted one third of "unaccompanied minors", resulting in the community far more represented. The problematic
child of that nationality is the rest from other sources:
in 2006, for example, about 11,413 foreign minors reported, 38% were Romanian.
They followed at a distance, those coming from Morocco with 14% (v http://giustiziaincifre.istat.it/).
Moreover, the distribution of citizenship to the children alone for 1 January 2008 does not neces sarily reflect the hierarchy of mature foreign presences.
The most represented are mostly from Palestine, Afghanistan and Iraq, those nationalities that are not among the 15 communities total more numerous in Italy. This figure suggests that the phenomenon has its own specific characteristics.
should be considered in addition that among the "unaccompanied minors" widely prevalent in males (over 90% of cases), and is still significant share of the smaller (under the age of 15 are one quarter of the total).
2.Cosa do for them?
According to a recent survey of the ANCI (National Association of Italian Municipalities), are 1,110 municipalities that between 2004 and 2007 took charge of an unaccompanied foreign children, mostly concentrated in Lazio, Emilia-Romagna and Lombardy.
Among the problem areas highlighted is the high economic burden on local welfare (an estimated average cost for a town of about 170 000 €) and a regulatory framework referred to as "complicated and ambiguous, which makes frammentata e molto diversificata la risposta che a questo delicato fenomeno viene data sul territorio nazionale.
Se il peso on resident aliens under 18 account for only about 6%, are not an Italian citizen when 60% of the inputs in penal institutions for minors

3.What are the problems for their inclusion in Italy
should first emphasized that the rules tend to hinder the integration of foreign children:
residence permit for minors ", which is issued to unaccompanied minors, which is currently not possible to exercise business activities and can not be renewed at the age of 18, except when there are certain very restrictive conditions, with the result that most of these guys After 18 years, even if they have jobs or attend school and become illegal immigrants subject to deportation.
The unaccompanied minors are so marginalized and increasingly at risk of exploitation in the context of undeclared or illegal activities.
E 'urgent that these provisions, which clearly violate the principle of "best interests of the child" to be varied, providing that the permit for allowing minors to work and can generally be converted to the coming of age in permission to work or study.
4.Il repatriation of unaccompanied minors
One problem is even more important consists of the return.
Minors generally can not be deported, but it may be placed on "assisted repatriation" of the child if an ad hoc body, the Committee for Foreign Children, states that this is the "best interests of the child."
The current orientation of the Committee for Foreign Minors, however, is that basically all the unaccompanied children in the family can be traced to the country of origin should be repatriated, except where this involves serious risks for the child .
In most cases the return is done forcibly by the police, against the wishes of the child and usually against the will parents, in a manner very similar to expulsion, and, moreover, that the child has no real opportunity to remind know.
Moreover, for many of these children return means returning in very poor, where there is very little opportunity for education, work and service.
This practice, therefore, does not seem to respond effectively to the "best interests of the child", but rather the need to combat illegal immigration of unaccompanied minors.
E 'must, therefore, that the criteria for deciding whether a child should be deported or remain in Italy to be modified to allow a real assessment of del minore, e quindi che il Comitato per i minori stranieri tenga in considerazione tra gli altri criteri, benché in modo non vincolante, anche l’opinione del minore, l’opinione dei suoi genitori e le condizioni economico-sociali del contesto d’origine.
Inoltre lo Stato comunitario carrying out the expulsion shall ensure that the child will be accom panied by a member of his family, a nominated guardian or at adequate reception facilities in the State of return.
Children irregular
addition to unaccompanied minors, then there are minors who have entered illegally into Italy with his parents or to join them.
In cases where the parents are undocumented, the current legislation provides that, in general, minority parents to accompany the king in case of their expulsion: even in these cases, however, would require a prior assessment of "best interests of the child" .
It should also be applied in a less restrictive rule under which the Court for minors may authorize the entry or residence of the family member with links to important reasons for the psychophysical development of the child.
Where parents are in order, however, rejoined the child "in fact" should be treated as the child reunited regularly and then get a residence permit for family reasons: the adoption of less favorable treatment such as the issuance of the permit for minors, as happens at some police stations, indeed, incompatible with the principle of "best interests of the child."
addition, to ensure the right of children to live with their parents and to implement the dictates of the law that in all proceedings relating al ricongiungimento familiare si deve tenere conto di tale principio, nonché per ridurre il numero di minori ricongiuntisi irregolarmente, si dovrebbero rendere meno restrittive le condizioni per il ricongiungimento familiare (condizioni relative al reddito, all’alloggio ecc.) e rendere più rapide ed efficienti le relative pratiche burocratiche.
i minori richiedenti l’asilo politico
Sul punto, merita di essere sottolineato che nel Dicembre del 2006 è stata Prodi issued by the Gover not an important directives on asylum for children that reinforces the assumption by the institutions.
The directive encourages the submission of the request for asylum and reduces waiting times - for his custody at a service specially dedicated - the arrival of a child in Italy until the delivery of his asylum application by the guardian ".
The goal is to prevent the boy escapes and ends in the network takes advantage of the chin with no legal protection but, more importantly, it becomes an invisible ".
arrival at the border, the younger, after taking charge of the court protect, the child will be immediately given to the National System of Protection for Asylum Seekers, and not to any structure as in the past.
Protection System, in addition to having a quota of places each year for vulnerable groups, has expertise and training to follow the child intentionally helping them during the difficult time of inclusion in a new and different cultural context.
addition, the Directive provides in Article. 1, which upon arrival are immediately given to the child all the necessary information about their rights and legal opportunities exist when there are willing to seek asylum. So far the
unaccompanied foreign children, even if the asylum seeker, was entrusted by the Local Police Station, pending that he be appointed guardian.
In the beginning was, therefore, accepted in a structure generally identified by the sensitivity available in the area and only later was included in the nal system of national security.
It was a delicate step because, pending the appointment of a guardian by the court and protect the boy was assigned to a structure of the National Security Service, revano If within a few months and often occurred that the child escaped and faccesse losing its traces there.
It contributes, therefore, to identify routes and locations of foreign aid to children, taking care that the time axes of intervention in their favor is to provide fast, so the protection they need. The
Directive provides that the child only to be informed immediately of the possibility of application for asylum with the help of cultural mediators, interpreters and brochures in the language.
If you experience this in mind, the protection procedure starts immediately, before it is materially the application. The Police Department relies
fact the guy at the municipality where it is being inserted into the central system of protection for asylum seekers and simultaneously inform the juvenile court and the magistrate is appointed as a guardian.
In this way the child will be immediately followed by social services until the present tion of asylum, through which the police will un permesso di soggiorno.
Atteso che la Convenzione dell’Aja del 1961 non contiene una definizione delle misure tendenti alla protezione del minore, né una elencazione esaustiva o indicativa,si debbano intendere icompresse nell’ambito della Convention: the protection, Art. 343 and following of the Civil Code, the emergency protection of public authority, Art. 403 Civil Code, the judicial proceedings relating to the exercise of parental responsibility, then Articles. 330 and following of the Civil Code, and more.
credit lines are also applied eterofamiliari Articles 2-5 of Law 184/83 and Article 37che adoption states applicable to foreign children in state of abandonment in Italy, Italian law on custody and adoption of necessary measures in case of emergency. Very important is also art. 371 cc to refer the matter to Judge Protects the task of determining the place where the child has to live under protection and that, compared with unaccompanied minors has been interpreted by analogy to some local areas, as the court of which allows the assessment of whether or not the child to remain in Italy or to be repatriated.
examination of the situation of the child only in Italy, appears in the following years as the Martelli Law, the rules that apply to these children was complex and heterogeneous.
In those years, thanks to the very pressing of the court, was obtained that our country would bring attention to the foreign children in general, beyond the existence in our country of a parent or family member regularly.
Taking a cue from the complex regulatory framework, the judicial practice as well as the experiences of collaboration between different local contexts, in 1994, the central authorities of the Ministry of the Interior, that of Justice and Labor decided to initiate a series of meetings and discussions that led to the establishment of circular. An attempt was made to regulate it uniformly on the national territory the question of the treatment of unaccompanied foreign minors.
Under these circulars, the police authority was taken away all power to determine the condition and treatment of the child, leaving the court with the difficult child e delicato compito di individuare la soluzione più confacente agli interessi supremi del minore richiamati dalla Convenzione Internazionale sui diritti del fanciullo.
Vedremo più avanti come questo orientamento, troverà conferma con L 40/98 but at least it appears, with the decrees of the law.
intervention of Juvenile Justice
From this analysis it appears that the most appropriate methods to be adopted in respect of unaccompanied foreign children, in the sense of return or his stay in Italy, are the responsibility of the Judicial child.
This belief is challenged today as a result of new regulatory instruments, which should transfer the jurisdiction of the administrative authority, because this issue seems now under the control of the Committee for Foreign Minors established by Law No 40/98, as it was amended by Legislative Decree no. 113/99, which is responsible for adopting the measure repatriation of unaccompanied foreign children after possible clearance of the juvenile court should be instituted legal proceedings against him.
fL'accattonaggio child in Italy
One of the most often in children who arrive in a European country like Italy, are exploited and begging.
It is one of the oldest forms of profit which sees the involvement of children and one of the most shameful ways in which a child is being exploited.
dell'accattonaggio The sad phenomenon of child labor in Italy began in the mid-eighties and saw the first use of children Slav Roma and then by Moroccan children, impegnati a chiedere l’elemosina e a lavare i vetri delle auto ai semafori.
capire dove dormono, cosa mangiano, a chi sono affidati, quante ore vengono tenuti in the street, and try
abuse they suffer. The same
inclusion of children in communities, homes and juvenile institutions is hampered by the lack of facilities and the hostility of the original families of the boys, and the latter, unwilling to adapt to a life controlled and organized, ready to away from places of shelter.
The Albanian mafia is known for violence against children that are sold to traffickers by their families and become slaves are malnourished, dressed in rags and sent to beg in order to attract the pity of the people.
If at the end of the day did not collect the minimum required, are intimidated e percossi.
Next to the task of begging are linked to other criminal activities which children are obliged to: theft, drug dealing, sexual exploitation, in addition to that, the young, are forced to live on the street, in a state of malnutrition, constantly subject to beatings if they do not earn as required or do not obey their exploiters.
Some children are instead "treated better" are those for pedophiles.
The possibility of their return is often very difficult due to the lack of identity papers, the hostility from the family home but also because begging "makes it" around the former 150,000 pounds per day, much of which goes to the organization, another to the family and about 10,000 former lire remain minor.
In 1998, in the Lazio region, were 4523 reports of cases of different types of child exploitation (prostitution, crime, begging, etc.)..
This underlines the need, across the nation, targeted interventions and definitive in respect of this form of exploitation of children, in compliance with all the rights set forth in the UN Convention for children.
A Constitutional Court ruling of 1997 stated that it is lawful to beg and beg, but it is a criminal offense to use for this purpose under the age of 14 (as reiterated a judgment -forse la prima in Italia- nei confronti di una donna Rom, emessa dalla pretura di Terni).
On the basis of the above reasons, the Supreme Court has therefore declared 'unacceptable' the use of human remains, therefore, in jail on charges of having exploited the baby beggars.
The decision is fully in line with the approach already expressed in the Supreme Court, which last year had upheld a ruling regarding abandonment of children one year and two months imprisonment with a gypsy, Zumra H., guilty to have abandoned the three minor children, under 14 years old (one was only two years), begging on the sidewalk of Via XX Settembre in Genoa.
The most obvious phenomenon of child exploitation is represented by children, especially in the central area or near the stations and sell all kinds of merchandise that are called "baby beggars."
sponges, wipes and lighters up their bargaining chip, sold in parking lots or traffic lights, someone buys, they are often turned away with annoyance, but many people wonder what to do there and denounce those who exploit them to the authorities or the unlawful exploitation.
For several years now, the investigators of the various public prosecutors are trying to find out who are the adults in charge of this organization.
i.Conclusioni
Significa annientare i suoi diritti.
I bambini mendicanti sui marciapiedi di città small and large are not in school, not playing, sleeping anywhere, live on the margins of starvation, disease, abuse, exploit chin.
For these children experience childhood is brief and often cruel.
hands outstretched in front of those who say 'I'm hungry, do not answer with a few coins to wash our own conscience in this way certainly does not liberate them from slavery to which they are forced, not liberate them from nothing.
then remember that behind those hands are criminal organizations that exploit them after they are kidnapped or bought, reducing them to slavery, destroying their dignity.
Instead of the money we give them something to eat, so we the "doubt" that had "contributed" to the racket dell'accattonaggio that generates exclusion.
According to the latest report of UN Secretary General, presented in New York and Rome, UNICEF and WHO, violence against children is a phenomenon common to all states of the world.
At least 54 000 children were, in fact, killed in 2002; 223 000 forced to have sex or otherwise forced physical contact, 218 million children are employed, of which 126 million involved in risky assets, 5.7 in forced labor or imposed for extinguish the debt, 1.8 million are victims of prostitution and pornography, 1.2 turn out to be victims del traffico di esseri umani; e tra i 100 e 140 milioni di ragazze hanno subito una muti lazione genitale.
Risulta che molti bambini frequentino regolarmente la scuola e nel pomeriggio vendano Cleaning and lighters to help the family remained in the country of origin.
Helping the family is therefore one of the main reasons for which children live in situations of exploitation and slavery, as in the case of many children of the Chinese community, who work 12, 13 hours a day on a sewing machine, in semi-clandestine laboratories where other Chinese Chinese advantage to emigrate should be advancing funds, which then must return to family and friends who are already here.
But the blame for this situation solely on the shoulders of parents or foreign com munity would be a mistake.
Such behavior is typical in the presence of a wild market, based solely on price as an element of competition.
It 's the so-called global market, international organizations such as UNICEF, cited as a source of exploitation and slavery.
In this bleak scenario, the child is often reified, reduced to a''thing''to''we''Wed, merchandise and that 'for many adults - as reported by the Fides dossier, and that's a good deal.
Before the spread of the phenomenon, it is time for the establishment of a National Observatory in Italy to immigrant children who, on the one hand, face the problem of juvenile crime and other foreign take care of preparing the instruments for intervention in such a sensitive matter that affects our society. Do not forget
